In an article published in Le Moniteur on January 31, Félix Avenel and Vincent Guinot, lawyers at Lacourte Raquin Tatar, review a Conseil d’Etat ruling of October 18, 2024, which clarifies the urban planning rules applicable in the case of a planned project within a subdivision, where the lot to house the project has not yet been sold.

The Conseil d’Etat has ruled that town planning rules are crystallized at the date of the subdivision PD or PA, provided that at least one of the lots has been sold by the developer, even though it is not intended to be built on.
