30 January 2023 Commercial mediation: where do we stand?

The Economic Justice Commission of the Cercle Montesquieu (Association of legal directors) has set up a working group (in partnership with the law firms Lacourte Raquin Tatar and Baker McKenzie as well as the business mediation centre Equanim International) to help companies and all their stakeholders to better know commercial mediation and to understand its interest for a better amicable resolution of their disputes.

This work takes place in a context that is more than favourable to commercial mediation, further reinforced by the implementation of the “amicable settlement policy” announced by the Minister of Justice on 13 January.

We share with you the first results of our working group’s survey on its use. These results come from questionnaires and interviews carried out in the last quarter of 2022 with legal directors, judges, lawyers and mediators. You will find the main obstacles and expectations identified as well as some illustrations of figures from our study.
