29 July 2022 AJDA : Review of the decision of the Conseil d'Etat

In an article published in the AJDA, Dalloz Editions, Félix Avenel reviews the decision of the Council of State dated April 22, 2022.
While an applicant is appealing to the Supreme Court against an order by which the president of the 9th chamber of the Administrative Court of Appeal of Marseilles judged her appeal to be unfounded, the Council of State is called upon to decide the following question: is it possible for an applicant against a building permit who has not justified his title of ownership in the first instance, whereas he was invited to do so by the administrative court or an end of non-receipt was opposed to him by the defendant, to do so for the first time on appeal?
